These terms apply to every use of https://the-pixel-grid.lovable.app. Owner of Pixels is the brand and platform operated by Artificialinnovators (Eenmanszaak (sole proprietorship)), Koning Willem-Alexanderplein 109, Dronten, Netherlands — Chamber of Commerce 98224948, VAT NL005317021B88.
1. What you are buying
Owner of Pixels is a single collaborative digital artwork consisting of exactly 1,000,000 pixels in a 1,000 × 1,000 grid. When you purchase pixels, you purchase a digital ownership right associated with the specific pixel coordinates you selected on this canvas.
This is not ownership of physical property, land, real estate, a security, a financial instrument, a token, a coin, an NFT or any blockchain asset. It grants no shareholding, no profit entitlement and no investment return. It is a right of use within this website, nothing more.
2. What a pixel owner may do
- Set the colour of each pixel you own, at any time, as often as you want.
- Draw across your own pixels with the brush tool.
- Place an image across a rectangular area consisting entirely of pixels you own.
- Undo and redo your own changes.
- Leave your pixels unchanged.
Creation tools only ever write to pixels you own. An uploaded image can never modify pixels outside the area you own; the server rejects any attempt to do so.
3. The artwork is public
The canvas is publicly visible to anyone, with or without an account. Everything you place on your pixels is public. Your username may be shown in connection with your pixels, in statistics and in public listings such as the leaderboard. Do not place anything on your pixels that you do not want to be public and permanent.
4. Other people's pixels are protected
You cannot modify pixels you do not own, and nobody can modify yours. This is enforced on the server. Attempting to circumvent these protections is a material breach of these terms and may lead to immediate termination.
5. Content rules
You may only upload or create content that you are legally entitled to use.
Prohibited content includes:
- Content infringing anyone's copyright, trademark, portrait or other rights.
- Sexual content involving minors, or any illegal content whatsoever.
- Pornographic or sexually explicit content.
- Hate speech, incitement to violence, harassment, threats, or discriminatory content.
- Extremist, terrorist or violent-extremist symbols and propaganda.
- Personal data of other people (names, addresses, phone numbers, photos of identifiable people without consent).
- Malware, phishing, scams, deceptive links, or misleading impersonation of brands or people.
- Content promoting illegal goods, services, gambling or financial schemes.
6. Copyright and infringement
You keep the rights to artwork you create, and you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and communicate it as part of the canvas, including in previews, thumbnails, exports and promotional material showing the canvas.
If you believe content on the canvas infringes your rights, contact us at zakelijkwoud@gmail.com with the pixel coordinates, proof of your rights and your contact details. We assess notices without undue delay and remove or disable infringing content where the notice is justified.
7. Moderation and removal
We may review, hide, reset to the default colour, or remove any content that violates these terms or applicable law, and we may do so without prior notice where the content is manifestly illegal or harmful. Removing the content does not remove your ownership right to the pixels: you keep the pixels and may place compliant content on them.
Where we take action against your content, we will inform you of the reason and you may object through our complaints procedure.
8. Accounts and termination
You need an account to purchase and to create. You are responsible for your login details and for everything that happens through your account. Accounts are for a single person or organisation; usernames must not impersonate anyone.
We may suspend or terminate an account in case of repeated or serious violations, fraud, chargeback abuse, or attempts to attack the service. In case of termination for cause, we may reset the affected pixels to their default colour. We will not refund pixels already delivered, except where the law requires it.

9. Transfer and resale
Pixel ownership rights are currently not transferable and not resellable. There is no marketplace, no secondary market and no trading functionality. Any transfer or marketplace feature that we may introduce later will be announced in advance and will be governed by the terms in force at that time. Do not purchase pixels expecting to resell them.
10. Availability and discontinuation
We aim to keep the canvas online and available, but we do not guarantee uninterrupted availability. Maintenance, incidents and third-party outages can occur.
If we ever discontinue the service, we will give at least 90 days' notice by email to registered users and on the website. Before shutdown, you will be able to download an image export of the canvas and of your own pixel area. After shutdown, pixel ownership rights end, because they exist only in relation to this canvas. Purchases made in the 14 days before the shutdown announcement will be refunded on request.
11. Price and payment
The price is €1.00 excluding VAT per pixel. VAT is added at checkout and is calculated by our payment provider based on your location. Payment is processed by Stripe; we never see or store your card details. Pixels are only assigned to you after the payment has been confirmed by Stripe.
12. Withdrawal
Purchases are digital content delivered immediately. See the Refund & Withdrawal Policy for your statutory right of withdrawal and how it applies.
13. Liability
Nothing in these terms limits liability for intent, gross negligence, death or personal injury, or any liability that cannot be excluded under mandatory law. Subject to that, our total liability is limited to the amount you paid in the twelve months before the event. We are not liable for indirect or consequential loss, lost profit, or loss of expected value of pixels.
14. Changes to these terms
We may change these terms. Material changes are announced at least 30 days in advance by email or on the website. Continued use after the effective date means you accept the new terms.
15. Applicable law
These terms are governed by the law of Netherlands. Mandatory consumer protection rules of your country of residence remain unaffected. Disputes are submitted to the competent court in Netherlands, unless mandatory law says otherwise. EU consumers may also use the European ODR platform at ec.europa.eu/consumers/odr.
